Land leaseholder wins appeal, eviction order reversed

In a recent legal victory, the High Appeals Court in Bahrain ruled in favor of a land leaseholder, overturning an eviction order brought by the Ja’afari Endowments Administration. The case revolved around a dispute over unpaid rent on a piece of waqf land. The Ja’afari Endowments Administration had sought to evict the lessee and recover 12,600 dinars in unpaid rent, claiming that the lessee had not paid the monthly rent from January 2017 to December 2023. The lower court had ruled in favor of the administration, ordering the eviction and payment of outstanding rent.

However, the lessee appealed the decision, providing evidence that they had paid rent for the entire year of 2023 and had renewed the lease agreement. The High Appeals Court found that the original lease had expired in 2018 according to the law, but determined that the lessee’s continued occupancy and the administration’s inaction resulted in a new lease agreement with the same terms but for a one-year duration. This ruling effectively dismissed the eviction order and upheld the lessee’s right to remain on the land.

This legal victory highlights the importance of understanding lease agreements and rights as a tenant or lessee. It also demonstrates the significance of presenting clear evidence and arguments in court to support one’s case.
