Court affirms dismissal of government school teacher found guilty of harassment

The High Administrative Court has upheld the dismissal of a government school teacher after rejecting her appeal against a decision, following charges of harassing another woman for 11 years. The Ministry of Education terminated her employment following her conviction. However, she appealed the Ministry’s decision before the High Administrative Court. The court ruled that the teacher’s continued employment would be “incompatible with the nature of her work,” particularly in the education sector as she is serving as a teacher. This decision is rooted in the Civil Service Law, which mandates the dismissal of public servants convicted of felonies or crimes that compromise their honour or integrity and limit their freedom. She argued that her dismissal was unjust, pointing to her positive performance evaluations and letters of appreciation from colleagues.

However, the court emphasised the necessity for high moral standards within the education sector. Role models “The education profession requires individuals who can serve as positive role models and nurture young minds,” the court stated. The conviction for harassment, considered morally reprehensible, justified her dismissal. The court further noted that maintaining the integrity of the education system is paramount. Consequently, it ordered the teacher to bear the legal costs associated with the lawsuit, reinforcing the principle that those in educational roles must uphold the highest ethical standards.

In conclusion, the High Administrative Court upheld the dismissal of a government school teacher after rejecting her appeal against the termination of her employment following charges of harassment. The court ruled that her continued employment would be incompatible with the nature of her work in the education sector.
