NBA legend Jordan sues NASCAR for anti-trust violations

NBA legend Michael Jordan’s auto racing team, 23XI Racing, has filed an anti-trust lawsuit against NASCAR and its CEO Jim France. The lawsuit, filed in the Western District of North Carolina, alleges that NASCAR has engaged in anti-competitive practices that have harmed teams, drivers, sponsors, and fans. Jordan, who co-owns the team with Front Row Motorsports, stated that he is willing to fight for a more competitive market where everyone can win.

The lawsuit claims that NASCAR and the France family operate without transparency, stifle competition, and control the sport of stock car racing in ways that unfairly benefit them. Among the allegations are that NASCAR buys top racetracks exclusive to NASCAR races, imposes exclusivity deals on NASCAR-sanctioned tracks, and prevents teams from participating in other stock car races. The teams also accuse NASCAR of forcing teams to buy parts from single-source suppliers chosen by the organization.

Front Row and 23XI Racing did not sign recently updated NASCAR charter agreements, citing unfair terms. After unsuccessful negotiations with NASCAR, the teams opted to pursue litigation as the only way to address the alleged anti-competitive practices of the organization. They plan to file a preliminary injunction to allow the teams to race in NASCAR next year while continuing with the anti-trust litigation.

Denny Hamlin, a 54-time NASCAR winner as a driver and part-owner of 23XI Racing, expressed his belief that everyone who invests in making the sport a success should share fairly in that success. He emphasized the need for changes in order to achieve this goal and ensure that all teams can benefit from NASCAR’s success. The lawsuit signifies a push for greater transparency and fairness in stock car racing.

In a joint statement, the teams emphasized their shared passion for racing, competition, and winning. They believe that change is necessary for the sport to thrive and become more competitive and fair, benefiting teams, drivers, sponsors, partners, and fans. The lawsuit reflects a commitment to fighting for a level playing field and ensuring that all stakeholders in the sport can enjoy the benefits of a more fair and competitive environment.

The legal battle between 23XI Racing, Front Row Motorsports, and NASCAR sheds light on the complexities and challenges within the world of auto racing. As the case unfolds, it will be interesting to see how the issues raised in the lawsuit are addressed and whether it leads to significant changes within NASCAR. The teams’ decision to pursue litigation demonstrates their determination to uphold the principles of fairness and competition in the sport, setting a precedent for potential reforms within the industry.
