UAE: Who is responsible for covering damages in an e-scooter versus car accident?

E-scooters and mopeds pose a potential threat to motorists and pedestrians in terms of safety and liability issues, as they are not registered and do not have insurance coverage. This raises concerns about who will be responsible for the damages in case of accidents involving these vehicles. In Dubai, there have been cases of fatalities and injuries resulting from accidents with e-scooters and bicycles, leading to increased scrutiny from authorities.

Dubai Police have recorded a significant number of traffic violations related to e-scooters and bicycles, with thousands of these vehicles being confiscated in the first six months of 2024. This highlights the need for regulation and enforcement to ensure the safety of all road users. It is essential for individuals to stay informed about the latest news and updates regarding this issue to prevent any potential risks or accidents.

In case of accidents where the vehicle owner is at fault, the insurance coverage depends on whether the driver has comprehensive or third-party motor insurance. The insurer of the vehicle will cover the damages to both the vehicle and the e-scooter rider in the former case, while the latter will require the driver to pay for their own car damages. Similarly, if the e-scooter rider is at fault, the car driver will be compensated by their insurance company, with potential legal action taken against the rider to recover losses.

The lack of specific insurance policies for e-scooters and mopeds in the UAE poses a challenge for both riders and vehicle owners. As their usage continues to increase, insurers need to develop tailored products to meet the evolving market needs. This proactive approach will not only address the gaps in coverage but also position insurers as leaders in adapting to modern mobility solutions. Insurance companies are exploring new products to meet market demand, but the low insurance penetration in this segment indicates a need for regulatory intervention.

In situations where the e-scooter rider is injured and at fault in an accident, the vehicle owner is not held liable for any injuries. The e-scooter owner may have to bear the repair costs for damages to the vehicle, unless otherwise agreed upon privately. Insurance coverage for e-scooters and other modern mobility solutions is crucial, and insurers need to be proactive in designing policies that align with emerging trends and lifestyles. By addressing the current gaps in coverage and providing adequate protection, insurers can ensure the safety and security of all road users.
