Strict penalties for those who violate the Private Employment Support system

The Human Resources Development Fund (HADAF), under the Ministry of Human Resources and Social Development, has recently approved a new regulation aimed at preventing violations of its Private Employment Support system. The regulation includes stringent punitive measures against violators, such as suspending their account in the HADAF’s automated system, recovering support amounts subject to violation, canceling support requests, and terminating support agreements. The Private Employment Support system aims to assist Saudi jobseekers in the private sector by subsidizing a portion of their wages for full-time positions.

The regulation outlines procedures for monitoring and proving violations, allowing HADAF to impose one or more penalties on violators. Violators may have the suspension of services lifted if they return the support amounts and comply with corrective measures. Individuals have the right to appeal violation decisions within 60 days of notification. The goal of the new regulation is to safeguard public funds, reduce violations, and combat misuse of employment support by establishing a regulatory framework for violations, clarifying procedures for proving violations, outlining penalties, and providing a mechanism for filing grievances against punitive measures.

Under the new regulation, HADAF officials will conduct field visits to establishments to oversee support program implementation. They will also verify the transfer of support funds to beneficiaries’ bank accounts through bank documents or the Madad platform, review support agreements and beneficiary documents, communicate directly with beneficiaries, meet with them, and confirm the accuracy of support-related data. HADAF emphasizes the importance of complying with program requirements to benefit Saudi jobseekers and encourage establishments to continue developing their businesses.

The HADAF’s board of directors adopted the new regulation to uphold the integrity of the Private Employment Support system and ensure that funds are allocated appropriately. Violators of the regulation will face severe penalties, including the suspension of their accounts and recovery of support amounts disbursed. The regulation allows for appeals within a specified time frame and emphasizes the importance of adhering to program requirements to benefit both jobseekers and establishments in the private sector.

The new regulation aims to enhance the monitoring and enforcement of support programs to prevent violations and promote accountability. By implementing stringent punitive measures, HADAF seeks to deter individuals from misusing employment support and ensure that funds are used for their intended purpose of assisting Saudi jobseekers in securing employment. The regulation also establishes procedures for addressing grievances against punitive measures, providing a mechanism for individuals to appeal violation decisions within a specified timeframe.

HADAF’s emphasis on transparency and accountability in the implementation of support programs underscores its commitment to safeguarding public funds and promoting the effective utilization of resources to benefit Saudi jobseekers and private sector establishments. By enforcing the new regulation, HADAF aims to maintain the integrity of the Private Employment Support system and uphold the principles of fairness and accountability in the allocation of support funds. The regulation’s provisions for monitoring, proving violations, and imposing penalties on violators reflect HADAF’s dedication to promoting ethical conduct and responsible utilization of employment support resources.
