Homeowner receives BD2,625 in compensation after furniture store does not deliver goods

A homeowner in Manama recently won a court case against a decor shop that failed to deliver promised interior design work. The homeowner had paid BD5,800 for the services, with an initial payment of BD3,000. Despite several attempts to resolve the issue directly, the contractor did not complete the work as agreed. The homeowner’s lawyer, Taqi Hussain Taqi, confirmed that the court ruled in favor of the homeowner, ordering the decor shop to pay BD2,625 in compensation.

The homeowner’s decision to take legal action came after the contractor failed to fulfill the terms of the agreement. Upon review, it was discovered that certain tasks had been cancelled, lowering the contract value to BD2,500. Despite this adjustment and a final notice issued, the contractor still did not complete the project. The homeowner then sought assistance from the Consumer Protection Directorate and the Capital Police, ultimately leading to the court case.

The court determined that the defendant’s sole proprietorship did not have a separate legal identity from its owner, making the dispute a personal matter. As a result, the homeowner sought to terminate the contract and receive a refund of the initial payment of BD3,000. In addition to the refund, the homeowner also requested compensation for the distress caused by the contractor’s failure to deliver on the agreed-upon services.
