The High Civil Court in Bahrain has recently ordered an insurance company to pay a compensation of BD36,000 to the family of a 17-year-old boy who tragically died in a traffic accident. The family decided to forgive the 19-year-old driver responsible for the accident and instead pursued legal action against the driver’s insurance company. The decision was based on the driver’s liability under the mandatory motor vehicle insurance law.

The family, consisting of six members, filed a civil lawsuit against the insurance company after the criminal charges against the driver were dropped due to a reconciliation agreement. Dr. Mohammed Al Kooheji, the family’s lawyer, represented them in court. Testimony was heard detailing the severity of the injuries sustained by the victim, including near-complete amputation of an upper limb and fractures to the skull and rib cage, as stated in the death certificate.

The court recognized the pain endured by the victim and awarded the family a compensation amount based on the damages and suffering caused by the accident. The decision highlights the importance of holding insurance companies accountable for the actions of insured individuals and ensuring that victims and their families receive the necessary compensation and support in such tragic situations.

The ruling serves as a reminder of the legal recourse available to victims of accidents involving insured individuals. It also emphasizes the role of insurance companies in providing financial assistance to those affected by such incidents. The family’s decision to seek compensation through a civil lawsuit demonstrates their commitment to ensuring justice for their loved one and holding those responsible for the accident accountable for their actions.

Dr. Mohammed Al Kooheji’s representation of the family in court showcases the important role of legal professionals in advocating for the rights of victims and their families in cases of personal injury and wrongful death. His efforts led to a successful outcome for the family, securing the compensation they deserved for the loss of their son. The court’s decision reaffirms the importance of seeking legal guidance and support in navigating the complexities of legal proceedings following a tragic accident.

Ultimately, the case highlights the need for a comprehensive understanding of insurance laws and legal rights in cases of personal injury and wrongful death. By seeking justice through civil lawsuits and holding insurance companies accountable for the actions of insured individuals, victims and their families can obtain the compensation and support they need to cope with the aftermath of such devastating incidents. The court’s ruling sets a precedent for ensuring that victims receive the necessary assistance and financial restitution in cases of negligence and personal injury.
