Annual Leave in the UAE: Understanding the Number of Days You Can Take, Carry Forward, and Everything Else You Need to Know

Annual leave regulations are an essential aspect of employment relations, ensuring that employees have the necessary time off to rest and recharge. In the UAE, an employee is entitled to 30 days of annual leave for each completed year of service with an employer. This entitlement is enshrined in Article 29(1)(a) of the Federal Decree Law No. 33 of 2021 on the Regulation of Employment Relations. In addition to this, an employee may only carry forward 15 days of annual leave to the following year as per Cabinet Resolution No. 1 of 2022. Any remaining leave days can be either taken or converted into cash based on the employee’s agreement with the employer.

If an employee does not take their annual leave, they have the option of requesting cash compensation instead. According to Article 19(1) of the Cabinet Resolution No. 1 of 2022, an employer may pay in lieu of annual leave not availed by an employee. The approval of annual leave is at the employer’s discretion, allowing them to decide whether the employee can take all 30 calendar days at once or split them into different intervals. Additionally, the maximum number of annual leave days an employee can take may vary depending on the company’s HR policy and the employee’s situation.

The rules regarding annual leave are clearly defined in the Employment Law, with specific provisions for situations where an employee leaves the job before utilizing their annual leave days. Article 29(9) of the Employment Law states that an employee is entitled to payment for the days of leave not availed if they leave the job before using them. This payment is calculated based on the employee’s basic wage. It is essential for both employers and employees to understand these regulations to ensure compliance and avoid any disputes related to annual leave entitlements.

Employers must also ensure that they are aware of the regulations governing annual leave to fulfill their obligations towards their employees.
