Sharia Court confirms the parentage of three children

Three children have recently been recognized as legitimate by a Sharia Court, resolving a dispute over their paternity. The case involved a woman and her estranged husband, with the court ruling that the three younger children were born within a valid marriage established by a contract. However, the eldest child was denied paternity due to being born less than six lunar months after the marriage.

The ruling was delivered following a case brought by the woman against her husband, with lawyer Jassim Al Issa representing him. Two government bodies, the Nationality, Passports and Residence Affairs, and the Information and eGovernment Authority were named in the proceedings, with the State Cases Authority acting on their behalf. The court based its decision on Islamic principles and provisions of Bahraini family law.

The woman claimed that her husband had neglected to apply for official documents for the children, prompting her to seek legal recourse. She presented evidence including a copy of the marriage contract, birth notifications, and other supporting documents. The court referred to Article 68 of the Family Code, which allows for paternity to be established through a valid marriage, acknowledgment, or clear evidence. Article 71 stipulates a minimum gestation period of six lunar months for confirming paternity.

The decision highlights the importance of legal documentation and adherence to family law in resolving disputes over paternity. By following Islamic principles and Bahraini family law provisions, the court was able to determine the legitimacy of the children in question. The case serves as a reminder of the significance of legal processes in safeguarding the rights of individuals and ensuring fair outcomes in family disputes.

The involvement of government bodies in the proceedings underscores the collaborative nature of legal processes in resolving complex family matters. By acting on their behalf, the State Cases Authority demonstrated a commitment to upholding the rule of law and ensuring justice for all parties involved.
