Fact check: Has Marine Le Pen’s appeal been denied?

Claims are circulating on social media platform X that French far-right leader Marine Le Pen’s appeal against a conviction barring her from running in the 2027 presidential election has been rejected. In March, Le Pen was sentenced to a five-year ban on holding public office after being found guilty of embezzling European parliamentary funds.

One widely shared post, which garnered over 600,000 views, stated that Le Pen’s appeal had been denied, sparking outrage among her supporters. However, the claim is misleading. To understand Le Pen’s current situation, it’s essential to examine the different legal challenges she’s pursuing.

Le Pen’s Legal Challenges

Le Pen has launched two separate appeals to try and overturn her presidential ban as quickly as possible. The first challenge was made to the Council of State, France’s highest administrative court, which rejected her appeal on October 15. This administrative challenge concerned her removal from the electoral list in the Pas-de-Calais department.

According to Camille Aynès, a constitutional law expert at the University of Paris Nanterre, Le Pen’s administrative challenge was an attempt to create a case that would allow her to raise a “priority question of constitutionality” (QPC), a special French mechanism that questions whether the law applied in her case violates the Constitution.

The Council of State ultimately refused to pass her challenge along, stating that the criminal provisions Le Pen contested were either non-existent or unrelated to her case. This rejection means Le Pen lost an opportunity to have the issue reviewed quickly.

Appeals Yet to Come

Despite claims that her appeal has been denied, Le Pen is launching a separate appeal against her criminal conviction, which is still pending. A trial has been scheduled from January 13 to February 12 next year, and a verdict is expected before the summer.

If Le Pen’s criminal appeal is successful, she may still be able to run in the 2027 presidential election. The outcome of this appeal is far from decided, and it’s the key to determining Le Pen’s future in politics.

European Union Involvement

Some social media posts claim that the “EU is behind” Le Pen’s ban, but this is also incorrect. The case and conviction are entirely under the French judiciary. The European Parliament’s role was limited to alerting prosecutors to potential wrongdoing.

According to Aynès, the European Parliament blew the whistle on Le Pen’s alleged misuse of funds, which led to her conviction. The case highlights the complexities of EU funding and national politics.

Le Pen’s National Rally party remains popular, with recent polling placing her between 33% and 37% support. However, her legal woes continue to unfold, and the outcome of her criminal appeal will be crucial in determining her future.

As the situation develops, it remains to be seen how Le Pen’s supporters will react to the outcome of her appeal. For now, the focus is on the upcoming trial and the potential implications for Le Pen’s political career.
