Court mandates phone store to refund customer for faulty iPhone

The High Civil Court recently ruled in favor of a customer who purchased a defective iPhone from a phone store, ordering the store owner to refund the purchase price and pay legal fees. The incident occurred when the plaintiff purchased a new iPhone 14 and experienced network connection issues shortly after. Despite efforts to resolve the problem, the store owner only offered a used phone as compensation, prompting the plaintiff to file a lawsuit against the store.

The plaintiff’s lawyer, Essam Al Tayeb, referenced relevant articles of the Civil Code to support his client’s case. Article 158 of the Civil Code states that those who cause damage to others are obligated to compensate them, while Article 161(A) specifies that compensation should cover both the loss incurred and the profit lost as a result of the unlawful act. Al Tayeb argued that the store owner’s failure to provide a functioning phone warranted either a replacement phone or a refund for the defective device.

Following the court’s ruling, the defendant was ordered to reimburse the purchase price of the phone, along with court fees and legal expenses totaling 100 Bahraini dinars. This case highlights the importance of consumer protection laws and the rights of individuals who purchase faulty products. By holding the store owner accountable for the defective iPhone, the court sends a message that businesses must uphold their end of the deal and provide customers with quality products.

The ruling in this case sets a precedent for future disputes between consumers and businesses in Bahrain, emphasizing the need for businesses to take responsibility for the products they sell. Customers have the right to expect that the products they purchase are in working condition and meet the standards set by the seller. This case serves as a reminder to businesses to adhere to consumer protection laws and to address customer complaints promptly and adequately.
