A former tenant of Muharraq Park has been ordered to pay 15,000 dinars to the Muharraq Municipality for damages caused during their tenancy. The company had leased the park for a festival, but failed to uphold its contractual obligations, leading to significant damage to the public space. The municipality initially sought 20,000 dinars in compensation, citing neglect of safety and security standards, resulting in deterioration of services. A technical report was obtained by the municipality to document the damage, which was accepted by the court. The court upheld the municipality’s claim and ruled in favor of the 15,000 dinar compensation amount.

Following the initial ruling, the tenant appealed, challenging the validity of the technical report. The Appeals Court appointed a joint expert panel to assess the damages, but the experts disagreed on the repair cost estimation. Despite this, the court ultimately sided with the municipality’s report, which estimated the repair cost at 15,000 dinars. The court found that the tenant had indeed caused significant damage to the park and validated the municipality’s report as being based on solid evidence. The compensation amount was slightly adjusted to 14,930 dinars to reflect the final assessment of the damages.

The court’s decision highlights the importance of upholding contractual obligations and maintaining public spaces in a safe and secure manner. By failing to adhere to safety standards, the tenant not only caused extensive damage to the park but also disrupted the quality of services provided to the public. The ruling serves as a reminder to all tenants and lessees to fulfill their responsibilities and obligations when using public spaces for events or activities.

The legal process involved in this case, from filing an urgent complaint to obtaining a technical report and presenting evidence in court, demonstrates the thoroughness and diligence required in seeking compensation for damages. The appointment of expert panels and the assessment of repair costs show the complexity of determining liability and ensuring fair compensation for damages caused. The court’s adherence to evidence-based rulings highlights the importance of sound reasoning and justification in legal decisions.

Overall, the ruling by the High Administrative Appeals Court sets a precedent for holding tenants accountable for damages caused during their tenancy. It underscores the importance of maintaining public spaces, upholding safety standards, and fulfilling contractual obligations to avoid legal disputes and financial liabilities. The reduced compensation amount reflects the court’s careful consideration of the evidence presented and the assessment of damages. This case serves as a cautionary tale for tenants and lessees to take care of public spaces and fulfill their responsibilities to avoid legal consequences and financial penalties.
