Former wife emerges victorious in legal dispute

A mother in Bahrain recently won a legal battle against her ex-husband to obtain her children’s passports and IDs. The woman, an expatriate, took legal action after her Bahraini ex-husband refused to hand over the documents despite several requests. The couple, who had three children, had their custody arrangement settled in the woman’s favor following their divorce. However, the ex-husband attempted to block the issuance of identity cards and a passport for their youngest child.

Lawyer Jassim Al Essa represented the mother in court and argued that Bahraini law supports the children’s right to these documents. He cited Article 4 of Decree-Law No. 12 of 1989, which states that children born to a Bahraini father are Bahraini nationals regardless of their birthplace. Additionally, Article 2 of Law No. 11 of 1975 guarantees Bahraini nationals the right to passports. Al Essa filed a lawsuit with the General Directorate of Nationality, Passports, and Residence Affairs to secure a passport for the youngest child and identity cards for all three children from the Information and eGovernment Authority.

The High Civil Court ultimately ruled in favor of the mother, ordering the issuance of a passport for the youngest child and identity cards for all three children. The court also directed the father to cover the legal fees. This ruling not only affirmed the children’s Bahraini citizenship through their father but also ensured their right to identity documents as residents of Bahrain. The outcome of this case highlights the importance of upholding children’s rights and following legal procedures in family disputes.

The mother’s victory in this legal battle serves as a reminder of the importance of protecting children’s rights, especially in cases involving custody arrangements and legal documentation.
