Contractor ordered to compensate client for delays and substandard workmanship

The High Civil Court recently ruled in favor of a client who took legal action against a contractor for delays and substandard work on a two-story villa construction project. The court ordered the contractor, a sole proprietorship, to pay the client 12,580.31 Bahraini dinars in compensation, along with interest and legal fees. The lawsuit originated from a contract signed between the client and the contractor, which outlined the construction of the villa for a set amount with a specific completion deadline. Despite additional work and an extended deadline, the construction remained incomplete after more than eight months, with significant defects identified.

In response to the unfinished and faulty construction, the client hired a structural engineer to assess the work. The engineer’s report concluded that the completed work was valued at a lower amount than what had been paid by the client, and highlighted additional costs to rectify defects in the electrical and plumbing systems. The court case proceeded without the contractor’s presence, as they failed to attend and provide a defense or evidence of payment. Ultimately, the court relied on the engineer’s report and the original contract, which included penalties for delays, to make its decision.

The court’s judgment ultimately ordered the contractor to pay the client the difference between the payments made and the value of completed work, in addition to the cost of repairing defects and a penalty for delays. The judgment also included interest, expert fees, translation costs, and legal fees, significantly increasing the total amount awarded to the client. The ruling serves as a victory for the client, holding the contractor accountable for the delays and quality issues in the construction project.

This case highlights the importance of ensuring clear and detailed contracts in construction projects to protect both parties involved. It also emphasizes the significance of meeting deadlines and maintaining quality standards in such projects. Clients need to be vigilant in monitoring construction progress and addressing any issues promptly to avoid significant delays and defects. Legal action can be an effective recourse in cases of contractual breaches or substandard work, as demonstrated by the favorable outcome in this situation.
