Bahraini Woman Ordered to Repay Dowry After Refusal to Return to Husband’s Home

The High Sharia Court in Bahrain has recently made a ruling ordering a woman to return her full dowry of 4,000 Bahraini dinars. This decision came after the woman refused to return to her marital home without any legal justification, despite a previous court order compelling her to do so. The case was brought to light by lawyer Noura Talal Bu Wardah, who represented the husband in this matter. The husband initially filed a case against his wife for leaving the marital home approximately two years into their marriage and refusing to return. The Sharia court ruled in favor of the husband, ordering the wife to return, but she ignored the court order and did not appeal.

Despite multiple attempts by the husband to reconcile with his wife, including sending her letters and engaging mediators, the wife remained steadfast in her decision to not return to the marital home. Even efforts made through the Family Reconciliation Office failed due to the wife’s absence. Subsequently, the husband filed a second lawsuit seeking a divorce and the return of the dowry, which included the mahr (bride price) and the shabka (jewelry given as a gift). The court took into consideration the wife’s continued refusal to comply with the previous court order, her failure to fulfill her marital duties, and the absence of any legitimate reason for leaving the marital home.

Article 54A of the Bahraini Family Law plays a significant role in this case, as it states that a wife forfeits her right to financial support if she refuses to move to or leaves the marital home without a valid reason, or prevents her husband from entering without a valid reason. Based on this law and the wife’s actions, the court granted the husband a divorce and ordered the wife to return the full dowry of 4,000 Bahraini dinars. Additionally, the court awarded the husband legal fees. Such rulings by the court emphasize the importance of upholding marital responsibilities and rights in accordance with the law.

This case sheds light on the legal implications of failing to comply with court orders in marital disputes.
