Bahraini Sales Representative Awarded 2,808 Dinars in Wrongful Termination Lawsuit

In a recent legal victory in Bahrain, a sales representative was awarded 2,808 dinars in compensation for unfair dismissal by the Court of Cassation. Despite the company’s attempts to justify the termination by labeling the employee as a slacker, the court rejected these claims. The court found that the company had not followed proper procedures, leading to the ruling in favor of the employee. The employee, who was on a fixed-term contract earning 300 dinars per month, was dismissed after just four months and nine days without a valid reason or proper notice.

Representing the employee, lawyer Fatima Khalaf argued that the company breached the Labour Code by failing to provide a 60-day notice period after informing him of his alleged low performance. The court agreed with Khalaf’s argument, noting that employees must be given a reasonable period to improve their performance before being dismissed as per Article 109 of the Labour Code. The court also highlighted that the company’s claim about the employee’s failure to meet sales goals was irrelevant as it was not included in the official termination letter. Additionally, there was no evidence to support the company’s assertion that the employee was verbally notified about his performance issues.

As a result of these violations, the court awarded the employee 2,400 dinars as compensation for wrongful dismissal, 300 dinars as notice allowance, and 107.5 dinars as additional compensation. This case serves as a reminder to employers about the importance of following proper procedures when dismissing employees. It emphasizes the necessity of providing clear reasons for dismissal and adhering to the notice periods outlined in the Labour Code to avoid legal repercussions. By failing to do so, companies risk facing legal action and potentially costly compensation payouts for wrongful dismissal.

This case showcases the significance of upholding employee rights and protecting workers from arbitrary dismissal. It underscores the importance of enforcing labor laws to ensure fair treatment and due process for all employees. The court’s ruling serves as a deterrent to companies engaging in unjust dismissal practices and sends a message that such actions will not be tolerated. This victory for the employee highlights the value of seeking legal redress in cases of unfair treatment and wrongful termination, demonstrating that employees have recourse to justice when their rights are violated.
