Dubai Court Orders Payment for Medical Expenses

The Dubai Civil Court has mandated a defendant to pay a total of 1.52 million dirhams to a hospital for medical bills incurred during the treatment and care of his father, who passed away after more than four months of hospitalization. The court’s verdict was influenced by the defendant’s signed ‘general consent’ document, which indicated his acceptance of financial obligations related to healthcare services rendered to his father, despite his claims of coercion.

The case unfolded when the defendant’s father was admitted to the hospital due to a critical decline in his health. Following initial emergency care, he was moved into the intensive care unit as his condition deteriorated further, requiring multiple medical interventions and treatments.

Background of the Case

Upon admission, the hospital reported that the son had signed a ‘general consent’ form authorizing medical care and acknowledging that he would bear the financial responsibilities for his father’s treatment. Initially, the hospital sought a claim of 1.153 million dirhams, later adjusting the total to approximately 1.54 million dirhams, accounting for additional costs that arose during the treatment period.

In response, the son denied responsibility for the claimed amounts, asserting that there was no evidence of the debt. He maintained that the consent form was signed under duress and contested the legitimacy of the invoices and financial documents provided by the hospital. Additionally, he requested the appointment of a committee of medical, pharmaceutical, and financial experts to review his father’s treatment and to halt the proceedings pending the outcome of a medical complaint he had filed with the Dubai Health Authority, alleging gross medical negligence by the hospital.

Judicial Findings and Implications

The court rejected the son’s defenses, emphasizing that he personally admitted his father to the hospital and signed the consent form, thereby establishing his standing in the legal proceedings. A court-appointed panel of a medical expert and a financial expert examined the situation, concluding that a contractual relationship was established via the signed consent document, which included his acknowledgment of liability for medical costs.

Upon reviewing medical records, daily reports, and test results, the expert team confirmed that the medical services and interventions provided were aligned with the patient’s clinical condition and were necessary under accepted medical standards. However, the investigation noted that several tests were conducted daily or almost daily, often without clear clinical justification, with results predominantly falling within normal ranges. As a result, after excluding costs associated with unnecessary tests, the court determined the remaining outstanding amount the son owed to the hospital was 1.52 million dirhams.

Conclusion and Future Considerations

The court also dismissed the request to pause the lawsuit pending the resolution of the medical complaint, reinforcing the idea that the case at hand was specifically about the financial obligations for treatment and services, distinct from the claims of medical malpractice. Furthermore, the son’s assertion that his signature on the consent form was obtained through coercion was not substantiated by any presented evidence.

This ruling emphasizes the legal responsibilities and consequences tied to signed agreements within medical settings. It serves as a critical reminder for patients and their families to fully understand the implications of consent forms in healthcare agreements. As the legal landscape continues to evolve, stakeholders in the healthcare industry, including patients and hospitals, should remain vigilant about their rights and obligations regarding medical care and related financial issues.
