Committee for Labor Arbitration Ensuring Justice in the Workplace

The Ministry of Labour in Oman has taken a significant step towards workplace justice by establishing the Collective Labour Disputes Arbitration Committee through Ministerial Decision No. 320/2024. Chaired by Supreme Court Judge Dr. Nasser Rashid Al Mushaifri, the committee aims to resolve collective labour disputes with a focus on balance, fairness, and protection of rights for all parties involved. The committee, in line with Article 121 of the Labour Law, is structured to represent all stakeholders fairly, including a president from the courts of appeal, an arbitrator from the Ministry of Labour, an employer-selected arbitrator chosen by the Oman Chamber of Commerce and Industry, and an arbitrator for workers designated by the General Federation of Workers.

To ensure continuity, each party involved is required to appoint substitute arbitrators, and the committee operates on a strict timeline to expedite resolutions. Hearings are scheduled within fifteen days of a dispute request, with final decisions issued within one month. Decisions are made by majority vote, with the president’s vote prevailing in case of a tie. The committee’s decisions are final, with appeals only permissible before the Supreme Court. The committee operates within existing legal frameworks, but also considers Islamic Sharia, customary practices, and principles of fairness, while taking into account prevailing economic and social conditions. The committee has the authority to call upon external experts for assistance, although these individuals do not have voting rights.

Munir bin Salem Al Rawas, Secretary of the Committee and Director of the Labour Negotiations Department, emphasized the committee’s commitment to equitable resolution processes. He stated that the Ministry of Labour is dedicated to resolving labour disputes and addressing challenges between workers and employers. The committee aims to promote justice in the work environment, providing objective and effective dispute resolution. By evaluating cases based on evidence and legal standards, the committee’s decisions seek to protect the rights of all parties involved and foster a balance of interests.

The establishment of the committee marks a significant progress in strengthening Oman’s labour dispute resolution framework and demonstrates the ministry’s dedication to safeguarding the interests of both workers and employers. The committee’s transparent and structured approach is expected to promote a more harmonious work environment and foster lasting workplace stability. The committee’s decisions are crucial in promoting workplace justice and maintaining a fair and balanced work environment for all stakeholders. Employers and workers can rely on the committee to resolve disputes efficiently and effectively, with decisions based on evidence and legal standards to ensure fairness and protection of rights.
