In a recent ruling by the High Appeals Court in Bahrain, a Bahraini woman’s appeal for divorce on the grounds of harm was rejected, with the court reaffirming the lower court’s decision in favor of her husband. The case centered around the wife’s allegations of threats, defamation, forced eviction from their marital home, and accusations of infidelity with a colleague at work. Despite these claims, testimony presented during the proceedings portrayed a different picture.
According to lawyer Abdulatheem Hubail, the lower court had previously ordered the wife to return to her husband, emphasizing the importance of marital obedience and prohibiting her from leaving the home without his permission. Dissatisfied with the ruling, the wife decided to file an appeal, restating her accusations of mistreatment, including physical and verbal abuse, allegations of infidelity, and eviction.
In response, the husband’s legal representative argued that the main conflict was between the husband’s mother and not the couple themselves. He claimed that his client had merely informed the wife’s father about her verbal abuse towards his mother and denied accusing her of infidelity. The appeals court then initiated an investigation into the matter, with witnesses testifying about the wife’s eviction and the financial support provided by her husband.
Witnesses for the wife acknowledged the financial support but denied witnessing any verbal abuse or threats from the husband, mentioning unsuccessful attempts at reconciliation. On the contrary, witnesses for the husband described him as loving and respectful, citing instances of financial support, including a loan for the wife’s university studies and covering medical expenses. They stated that the husband never accused her of infidelity or theft, claiming that she voluntarily left the marital home.
After careful consideration of all evidence presented, the High Appeals Court dismissed the wife’s appeal, thereby upholding the lower court’s decision. Consequently, the wife is now legally obliged to return to the marital home and comply with her husband’s wishes. This ruling highlights the complexities of marital disputes and the importance of thorough examination of evidence in family law cases.
