Man Ordered to Repay 9.9 Million Dirhams to Friend

Legal Dispute Arising from Friendship Ends with Court Ruling

A former friendship between two men has culminated in a legal dispute valued at millions of dirhams, as one man demanded the return of approximately 14.6 million dirhams. He claims this sum was transferred to his friend over several years of financial dealings. Ultimately, the court ruled that the defendant must return 9,990,000 dirhams, which represents shares in a company that were not transferred to the plaintiff. The court dismissed the remaining claims due to insufficient evidence supporting the transfers.

The case stems from a previous friendship that lasted from 2021 to 2024, during which the plaintiff conducted numerous financial transactions with the defendant, amounting to 5,385,248 euros. As payment requests piled up, the plaintiff asserted that he repeatedly asked his friend to return the funds but failed to receive a resolution. Consequently, he turned to the judiciary, initially filing a request to appoint an expert to scrutinize the financial records and clarify their relationship.

Court Findings on Financial Transfers

An expert examination revealed that the plaintiff had transferred a total of 20,800,000 dirhams to the defendant, while the defendant had only returned approximately 180,500 dirhams. This resulted in a net difference of 20,619,500 dirhams. However, the court did not consider this entire amount as an outstanding debt. It emphasized that mere existence of bank transfers does not automatically warrant repayment; it necessitates proof of the purpose behind the transfers and the legal basis for them.

The fundamental principle of bank transfers is that they typically signify fulfillment of a debt or existing obligation between the parties. In reviewing the evidence, the court identified 9,990,000 dirhams as the value of an agreement to sell shares in a company. The plaintiff supplied documents supporting the agreement and the payment, but failed to prove that the shares were physically transferred or that any modifications to the license or commercial registry were executed. The defendant, for his part, did not furnish evidence to indicate that the share transfer had been completed or that he had fulfilled the contractual obligations linked to the amount he received.

The Implications of the Court’s Decision

The court asserted that contracts impose obligations on both parties, and generally, each side is required to fulfill its contractual duties as agreed. It also highlighted that performance should align with the contract’s terms and reflect good faith. Consequently, the court ordered the defendant to repay 9,990,000 dirhams, justified by the established purpose and documentation related to this specific amount.

Conversely, the court denied the plaintiff’s request for the remaining funds, determining that he did not provide sufficient documentation for certain transfers. The court noted that the burden of proof lies with the one claiming the right, and in this case, the plaintiff did not present enough evidence to substantiate the reasons for his debt claims regarding a portion of the total amount. Additionally, the expert report did not uncover documentation supporting this aspect of the claim.

Conclusion and Next Steps

The court clarified that the expert’s role is limited to reviewing the documents presented before it, and the assessment of the evidence falls within the domain of the trial court. The court expressed confidence in the conclusions reached in relation to the evidence provided. It articulated the distinction between merely having financial transactions between two parties and establishing a debt. A bank transfer does not inherently indicate that the amount is a debt due for repayment unless the actual reason and corresponding obligation have been established.

In conclusion, the court’s ruling obliges the defendant to return just under ten million dirhams. While the plaintiff was successful in part, a significant portion of his financial claims was dismissed. Observers of this case should stay tuned to see if there are further legal steps or appeals taken by either party in light of this ruling.
