The High Administrative Court recently dismissed a worker’s appeal against a deportation order due to a missed deadline. The court emphasized that appeals against such decisions must be submitted within 30 days of notification. Failure to do so results in the forfeiture of the right to appeal. The worker had applied for a residency renewal but received a deportation order instead. Despite his appeal to the Protection and Appeals Centre, the deportation order was upheld.

Citing Article 33 of Law No. 19 of 2006 concerning the regulation of the labor market, the court explained the procedures for appealing decisions under the law. Any interested party may appeal within 30 days of notification, depending on the issuing authority. The appeal must be adjudicated and the outcome notified within 30 days of submission. Additionally, the law allows an appeal against the rejection of the initial appeal within 30 days or the expiry of the deadline without a response. Missing this deadline results in the forfeiture of the right to appeal.

In this particular case, the worker’s appeal against the rejection of his initial appeal was filed late, on 12th December 2023, exceeding the 30-day deadline. Therefore, the court ruled that it was inadmissible and ordered the worker to pay court fees. This emphasizes the importance of adhering to deadlines when filing appeals against deportation orders or other decisions under the Labor Market Regulation Law.

It is crucial for individuals facing deportation orders or other decisions related to labor market regulations to understand the appellate process and adhere to the specified deadlines. Missing these deadlines can result in the forfeiture of the right to appeal, as seen in the case of the worker whose appeal was dismissed due to a late filing. Seeking legal advice in such situations is advisable to ensure compliance with the law and increase the chances of a successful appeal.

The High Administrative Court’s decision in this case serves as a reminder of the strict deadlines set out in the Labor Market Regulation Law for filing appeals. Adhering to these deadlines is essential to protect one’s rights and have a fair opportunity to challenge decisions such as deportation orders. Understanding the legal procedures and seeking timely advice can help individuals navigate such challenging situations while ensuring they comply with the law.

In conclusion, the High Administrative Court’s dismissal of the worker’s appeal against a deportation order highlights the significance of filing appeals within the specified deadlines. Failure to adhere to these deadlines can result in the forfeiture of the right to appeal, as seen in this case. Seeking legal guidance and understanding the procedures outlined in the Labor Market Regulation Law is crucial for individuals facing similar situations to have a fair chance at challenging such decisions. It is vital to be aware of the applicable laws and regulations and to act promptly to protect one’s rights in such circumstances.
