Bahrain Court Reverses Decision, Mandates Man to Pay Wife’s BD30,000 Dowry

The High Appeals Court in Bahrain recently overturned a lower court ruling that required a man to transfer ownership of a house to his ex-wife and pay her a total of 30,000 Bahraini dinars, including a deferred dowry and an equivalent dowry. The man’s lawyers argued that the marriage contract stipulated a dowry of 20,000 Bahraini dinars, which included a house to be registered in the ex-wife’s name. However, the ex-wife never received the deferred dowry and the house was never transferred to her as agreed upon in the contract.

The lower court initially ruled in favor of the ex-wife, ordering the man to pay the deferred dowry and transfer ownership of the house to her. However, the man appealed the ruling, leading to the case being reviewed by the High Appeals Court. In its judgment, the High Appeals Court noted that the marriage contract specified a 10,000 Bahraini dinar immediate dowry and a 10,000 Bahraini dinar deferred dowry, along with a house to be registered in the ex-wife’s name. However, the lack of a specific description of the house in the contract rendered the agreement invalid.

The High Appeals Court determined that the deferred dowry of 10,000 Bahraini dinars and the “Mahr al-Mithl” (equivalent dowry) should be paid by the man to the ex-wife, as per the terms of the marriage contract. The court highlighted the importance of clarity in agreements, especially when it comes to valuable assets such as property. The court found the lower court’s ruling to be faulty due to insufficient reasoning and incorrect interpretation of the law.

In light of the court’s decision, the man was ordered to pay the 10,000 Bahraini dinar deferred dowry and an additional 20,000 Bahraini dinars as “Mahr al-Mithl”. The ruling emphasized the importance of adhering to the terms of marriage contracts and ensuring that all parties involved are treated fairly and in accordance with the law. This case serves as a reminder of the importance of clarity and specificity in legal agreements, especially in matters of property and financial obligations.

Overall, the High Appeals Court’s decision in this case highlights the need for clear and precise language in marriage contracts to avoid confusion and disputes.
