Criminal Case Dismissed Due to Appellant’s Death

A recent criminal case in Bahrain involving a consumer protection complaint against an establishment specialized in fitting kitchens has been dismissed by the Court of Cassation due to the death of the appellant. The appellant, a woman who filed the complaint, had alleged non-delivery of a kitchen and claimed a sum of 2390 dinars. According to lawyer Ahmed Touq, the Public Prosecution had charged his client with failing to comply with a binding decision from the Consumer Protection Directorate in 2023. This came after a complaint from the woman against his client’s establishment, which detailed an agreement to refund the amount after the kitchen installation was not completed as agreed.

Initially, a lower court had imposed a fine of 100 dinars on the appellant, which was later overturned upon appeal. However, the Public Prosecution appealed this decision, leading to the High Criminal Court overturning the acquittal and imposing a fine of 1000 dinars. The fine was later reduced back to 100 dinars after a further challenge. Mr. Touq filed an appeal to the Court of Cassation on January 31, 2024. However, the court cited data from the Ministry of Interior confirming the appellant’s death on May 11, 2024, after the appeal was filed. This led to the dismissal of the case based on Article 17 of the Code of Criminal Procedure, which states that criminal proceedings are extinguished upon the death of the accused.
