Husband fined by top court for eavesdropping on wife’s phone calls

The Cassation Court in Manama recently upheld a lower court’s ruling, which fined a husband BD50 for illegally recording his wife’s phone calls without her consent, resulting in harm to her. The husband was charged with a misdemeanor by the Public Prosecution in 2022 for secretly recording his wife’s phone calls without her permission. He had placed listening devices in her bedroom and car, allowing him to eavesdrop on her conversations with their daughter and a friend. Additionally, he shared the recordings with her brother, playing a conversation she had with a friend, causing distress to his wife and daughter.

Initially, the Public Prosecution issued a criminal order, fining the husband BD20 and confiscating the seized devices used in the crime. However, the husband objected to this order, leading the Lower Criminal Court to drop the criminal order and instead fine him BD50 for the offense, confiscating the seized devices. Unsatisfied with this ruling, the husband decided to appeal the decision. The Court of Appeals upheld the lower court’s judgment, prompting him to appeal once again before the Cassation Court.

The Cassation Court ultimately rejected his appeal and upheld the previous ruling, maintaining the husband’s fine of BD50 for illegally recording his wife’s phone calls without her consent.
