Amal Clooney backs ICC’s decision to pursue arrest warrants for Israeli and Hamas leaders

Amal Clooney, a prominent human rights attorney, has joined a group of legal experts to advise the International Criminal Court (ICC) prosecutor on seeking arrest warrants against the top leaders of Israel and Hamas. The panel, convened by ICC prosecutor Karim Khan, found “reasonable grounds to believe” that the individuals named in the arrest warrants have committed war crimes or crimes against humanity. Clooney, who has represented victims of mass atrocities, explained her involvement in a statement, citing her belief in the rule of law and the need to protect civilian lives.

The legal panel, which included renowned experts such as Theodor Meron and Lord Justice Fulford, unanimously determined that the ICC has jurisdiction over crimes committed in Palestinian territories and by Palestinian nationals. They found that Hamas leaders Yahya Sinwar, Mohammed Deif, and Ismail Haniyeh have committed war crimes and crimes against humanity, while also concluding that Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant have also committed such crimes. The panel’s findings will now be considered by a panel of ICC judges.

Both Hamas and Israeli politicians have condemned the arrest warrants, with Netanyahu calling it a “travesty of justice” and an “outrageous decision.” The application for warrants marks the first time the ICC has targeted the top leader of a close ally of the United States. Israel and the US are not members of the ICC, but the court claims jurisdiction over certain territories where crimes have been committed. The Biden administration has denounced the ICC’s move, emphasizing that there is no equivalence between Israel and Hamas.

Amal Clooney, who is a barrister at Doughty Street Chambers in London and an adjunct professor at Columbia Law School, is known for her work in representing victims of genocide and other human rights abuses. Alongside her husband George Clooney, she co-founded the Clooney Foundation for Justice, which provides free legal support to victims of abuses of power. Clooney has been involved in advocating for Yazidi victims of genocide, as well as victims in Sudan’s Darfur region.

Clooney’s involvement in advising the ICC prosecutor highlights her dedication to upholding the rule of law and seeking justice for victims of war crimes and atrocities. Despite facing criticism for not speaking out earlier on Israel’s actions in Gaza, Clooney’s participation in the legal panel underscores her commitment to protecting civilian lives and holding perpetrators of war crimes accountable. The legal experts’ unanimous findings demonstrate the gravity of the situation and the need for accountability for those responsible for committing such crimes.

As the ICC moves forward with considering the application for arrest warrants, the international community will be closely watching how the legal process unfolds and what implications it may have for future accountability and justice in conflicts around the world. Amal Clooney’s involvement in this high-profile case further solidifies her reputation as a fierce advocate for human rights and justice, using her legal expertise to make a difference in the lives of those affected by violence and conflict.
