Abu Dhabi Court Refuses Claim for 156,000 Dirham Loan Repayment

The Abu Dhabi Family and Civil Administrative Court has dismissed a young man’s lawsuit against his friend, in which he sought repayment of 156,000 dirhams. The plaintiff alleged that he had lent this amount on multiple occasions, supported by bank transfer evidence. However, the court ruled that these financial transfers alone did not substantiate the existence of a debt or the purpose of the transfers.

In the specifics of the case, the plaintiff filed a lawsuit requesting the court to compel his friend to repay the principal loan of 156,000 dirhams. Additionally, he sought 94,000 dirhams in damages along with a 5% legal interest rate from the date of demand until the loan was repaid in full. He also requested an immediate ruling without the need for a guarantee, along with the imposition of court fees and costs. The plaintiff alleged that the defendant had frequently requested financial assistance due to personal difficulties, leading to the multiple bank transfers.

Details of the Legal Proceedings

The plaintiff presented various forms of evidence to support his claim, including screenshots of communications via WhatsApp and documentation showing the amounts and frequency of the bank transfers. Despite being duly notified, the defendant failed to appear in court or provide legal representation, further complicating the proceedings.

The court examined the submissions and clarified that, according to legal principles, a bank transfer merely signifies the transfer of funds from one individual to another. The burden of proof lies with the party asserting the existence of a debt. Furthermore, the court maintained that the presumption is always in favor of the debtor’s innocence unless otherwise proven, which requires concrete evidence demonstrating the claim.

Legal Implications and Court Ruling

The court’s ruling emphasized that merely providing evidence of bank transfers does not inherently validate the claim of indebtedness. The ruling stated that the evidence presented was insufficient to confirm the legitimacy of the debt or the reasoning behind the transactions. Consequently, the court upheld the principle that it is not obligated to prompt the defendant to present evidence in their defense, instead basing its judgment solely on the evidence presented by the plaintiff.

The judgment concluded with the dismissal of the plaintiff’s claims, holding him accountable for the associated court fees and expenses incurred during the legal process. This ruling sets a significant precedent regarding the necessity of proof to establish a debt in similar future cases.

Conclusion and Future Considerations

As the legal landscape surrounding financial transactions continues to evolve, this case underscores the importance of comprehensive documentation when pursuing loan repayments. Individuals engaging in personal lending should consider formal agreements that outline the terms of repayment to avoid similar legal disputes. Observers are encouraged to monitor future rulings that may further clarify the evidentiary standards required in debt-related cases.
