Federal Appeals Court Upholds Acquittal of Young Man in Family Assault Case

A federal appeals court in Ajman has rejected the prosecution’s appeal against the acquittal of a 22-year-old man, affirming the lower court’s decision to free him of accusations regarding a physical assault on his father. The court found insufficient evidence to support the claims against the young man and noted that surveillance camera footage raised doubts about the allegations.

The legal dispute originated from a complaint made by the son, who accused his 67-year-old father of physically attacking him at their family home in Ajman. The conflict arose after the son refused to withdraw a legal case he had filed against one of his father’s siblings.

Details Surrounding the Incident

According to court documents, the father requested that his son retract the case, which led to a heated argument. During the confrontation, the father allegedly struck the son with a wooden stick in various parts of his body, with the attack happening in the presence of the boy’s mother, sister, and cousin. Following the incident, the son went to a police station to report the attack.

During the investigation, the mother of the complainant confirmed that her husband assaulted their son with a stick due to his refusal to drop the lawsuit. Conversely, the son claimed that he only acted in self-defense, asserting that he was the one who took control of the stick after being attacked and broke it to stop further violence.

The father admitted the argument occurred but denied assaulting his son. He stated that during the scuffle, his son snatched the stick from him and that he sustained injuries in the process. A medical examination confirmed that the father had multiple scratches and bruises, which exacerbated the complexity of the case.

Legal Proceedings and Evidence Consideration

The prosecution charged both the father and son with mutual assault and referred the case to the appropriate court. Video footage reviewed by the court lasted for 1 minute and 26 seconds, showing the father entering the son’s room holding a wooden stick, repeatedly striking him before the son forcibly took the stick away and broke it.

The initial ruling by the lower court cleared the son of any wrongdoing, while the father was sentenced to six months in prison along with a fine of 10,000 dirhams. Following this ruling, the prosecution appealed the decision concerning the son’s acquittal.

In a subsequent hearing, the appeals court initially overturned the son’s acquittal, convicting him and imposing a one-month prison term along with a 5,000 dirham fine. However, the son contested this decision at the Federal Supreme Court, which nullified the ruling, citing a lack of comprehensive details regarding the case and the evidence justifying the allegations.

Final Ruling and Legal Implications

As the case returned to the appeals court for reconsideration, the son maintained his innocence, while his defense team argued for a reestablishment of the acquittal. The prosecution, however, remained steadfast in its stance against the son.

Ultimately, the appeals court reached a conclusion based on the surveillance footage, which supported the son’s assertion that his father initiated the altercation. The court further elucidated that the father’s injuries were not definitive proof of deliberate harm inflicted by the son, as they might have occurred during the struggle for the stick.

The ruling emphasized the legal principle that criminal convictions should be based on certainty and clarity, noting that doubt in such cases should work in the defendant’s favor. The court officially accepted the prosecution’s appeal in process but denied its argument, thereby upholding the son’s acquittal.
