Court Orders Young Woman to Pay AED 407,137 to Car Rental Company

The Abu Dhabi Commercial Court has mandated a young woman to settle an outstanding amount of AED 407,137 for defaulting on her financial obligations under a car rental agreement. The monthly rental fee for the vehicle was AED 20,000, and included overdue payments, bounced checks, traffic fines, and repair costs for the vehicle, along with other fees specified in the contract.

The car rental company initiated a lawsuit against the woman, seeking to recover AED 407,137 plus interest, along with AED 5,000 for expert witness fees, and to cover legal expenses. The company supported its claim with a vehicle rental contract dated January 24, 2025, and attached documentation including the rented vehicle’s registration.

Details of the Legal Proceedings

The court highlighted that, according to established legal principles, a rental agreement represents a contract whereby the lessor must provide the lessee the ability to utilize a specified asset for a designated period in exchange for a known fee. Rent is due based on the enjoyment of the leased property or the ability to access it. As per the findings of the appointed expert, the relationship between both parties originated from a vehicle rental agreement.

The ruling emphasized that while the rental company fulfilled its contractual obligations, the young woman breached her commitments by failing to pay the required rent. She had issued eight bounced checks totaling AED 160,000, incurring additional fees of AED 16,000 for those checks. Moreover, other liabilities had arisen from traffic violations and usage that exceeded permissible mileage, as well as maintenance and repair costs.

According to the expert’s assessment, the total amount owed by the young woman to the rental company amounted to AED 407,137. The court expressed confidence in the expert’s conclusions, noting that they were based on sound technical and financial principles. The judgment confirmed that the amount owed matched the figures in the company’s account statement.

The court’s decision requires the young woman to pay AED 407,137 along with an annual interest rate of 5% until full repayment is completed, capping it at the principal amount. Additionally, the court ordered her to compensate the rental company with AED 5,000 for the expert’s fees, along with court costs and AED 200 for attorney fees. The court rejected other claims made by the car rental company.
