Is It Permissible to Film Someone Committing a Violation in a Public Place and Share the Video on Social Media?

The question of whether it is acceptable to film someone committing an offense in a public space and then upload that video to social media platforms has gained substantial attention in recent years. In many places, including Dubai, individuals may not automatically have the right to record others and share that content with the intent of public shaming or exposure. Legal principles distinguish between documenting an incident for reporting purposes and turning it into public content that invades a person’s privacy or reputation.

Legal Framework Surrounding Privacy and Filming in Public

Article 44 of the Federal Law No. 34 of 2021 on Combatting Rumors and Cybercrimes clearly outlines the illegality of using information technology to violate an individual’s privacy. This applies to capturing images of others, whether in public or private spaces, and sharing or retaining those images without consent. Furthermore, this legislation criminalizes the publication of photos, videos, or information, even if they are factual, if the intent is to harm the subject. Violators could face imprisonment for no less than six months and fines ranging from 150,000 to 500,000 AED, or one of these penalties.

Additionally, Article 431 of the Federal Penal Code No. 31 of 2021 reinforces the sanctity of personal and family privacy, criminalizing unauthorized filming, recording, or sharing of private matters when the described situations are violated without the individual’s consent. This underscores the importance of respecting personal boundaries, even in supposedly public contexts.

The Importance of Intent When Filming Violations

From a legal perspective, if an individual witnesses a violation or behavior that may be deemed criminal, the primary focus should be on reporting rather than exposing the person publicly. It is advisable to record the incident to the extent necessary for evidential purposes and subsequently report it to the authorities rather than uploading it online. This practice helps prevent a public trial by social media before the person is given a chance to face legal proceedings.

Legal experts argue that documenting an incident should ideally serve the purpose of informing law enforcement, rather than vilifying the individual involved. Sharing such content on social media could lead to unwarranted consequences and further legal issues for the person sharing the information.

Balancing Public Interest and Individual Privacy

As technology evolves, the lines between public interest and personal privacy increasingly blur. Social media can create a platform for raising awareness about societal issues, but it can also facilitate a form of mob justice that may violate legal protections. Therefore, individuals must tread carefully when deciding to document and share such incidents. Respecting privacy and adhering to the law should be paramount considerations.

It is crucial for the public to understand that while they may feel compelled to share violations they witness, they must also consider the broader implications of their actions. Engaging with law enforcement to rectify a situation underscores a lawful and responsible approach, ensuring that justice is served without compromising individual rights.

Future Directions Regarding Privacy Laws and Social Media

Looking ahead, as social media platforms continue to grow and influence public discourse, the legal system may need to adapt by developing clearer guidelines regarding privacy rights in the digital age. Stakeholders, including lawmakers, legal experts, and the general public, should engage in discussions to foster a balanced approach that respects both the right to inform and the right to privacy.

As awareness of these legal frameworks increases, individuals are encouraged to act responsibly in their use of technology. By fostering a culture of reporting rather than shaming, society can build a more respectful and lawful environment for all.
