Professor Marike Patrani Paulsson, Secretary General of the Council for International Dispute Resolution of the Kingdom of Bahrain, recently contributed to this vital conversation at the 4th IBA India Litigation and ADR Symposium in New Delhi, focusing on the complexities surrounding data protection and freedom of expression. Her participation highlights the global urgency of navigating these challenges as digital landscapes evolve.

Balancing Privacy and Freedom of Expression: Key Discussions at the IBA Symposium

The IBA India Litigation and ADR Symposium, held at the Taj Mahal Hotel in New Delhi, brought together a distinguished group of legal minds, policymakers, and technology experts. The central theme revolved around the evolving relationship between individual privacy, responsible digital governance, and the protection of fundamental rights – particularly freedom of expression. Professor Paulsson participated in a panel titled: “Privacy, the General Data Protection Regulation (GDPR), and India’s Digital Personal Data Protection Act: Where is freedom of expression on the one hand and the regulation of social media on the other?”

This discussion was particularly timely given the implementation of India’s Digital Personal Data Protection Act and its relationship with established frameworks like the GDPR. The need for a nuanced approach that doesn’t stifle legitimate expression while safeguarding personal data was a recurring point. The symposium acknowledged the increasingly fragmented nature of global data privacy laws. While the GDPR has established a high standard for data protection within the European Union, numerous other countries are developing their own regulations, often with differing approaches.

This creates significant challenges for multinational corporations and individuals alike. The need for greater international cooperation and harmonization of data protection standards was a common thread throughout the event. Countries like India, with its burgeoning digital economy, are particularly focused on building robust frameworks that balance economic growth with individual rights.
