Daughter wins legal battle against father for not giving financial support

A university student in Bahrain recently made headlines after successfully suing her father for failing to provide her with financial support for her education. The court’s decision in her favor, which was upheld on appeal, has set a precedent for similar cases involving parents who neglect their financial obligations towards their children. The young woman, represented by lawyer Isa Al Widae, argued that her father, a government employee with a monthly salary exceeding 900 Bahraini dinars, was fully capable of supporting her university expenses. Despite his claims that he already provided for his family and that his daughter worked at a café, the court ruled in favor of the daughter, citing relevant articles in the Family Law regarding parental responsibilities towards their children.

The case revolved around the father’s refusal to contribute towards his daughter’s university expenses, despite his financial capability. The woman, who is unmarried and unemployed, argued that her father had sufficient income from his job and other business ventures to support her education. The father, on the other hand, claimed that his daughter already had access to family resources and was working at a café, receiving an income. Article 62/A states that a father is responsible for the expenses of a minor child until the daughter marries or the son reaches an age where he can earn a living. Additionally, Article 46 emphasizes the right to financial support, ensuring that children are provided with essential necessities such as food, clothing, and shelter. In this case, the court ordered the father to pay his daughter a monthly allowance of 60 Bahraini dinars, a decision that was upheld by the Court of Appeals despite the father’s attempt to appeal.
