UAE: Do anti-smoking laws and fines apply to vaping in offices?

In the UAE, smoking and vaping are prohibited in enclosed public spaces and workplaces under federal law. Despite this, the use of e-cigarettes and vaping devices continues to be a prevalent issue in many offices across the country. Minor violations result in immediate fines of Dh500, while serious or repeat offenses could lead to severe penalties. Colleagues often tolerate the behavior, assuming it is legal, but anti-smoking laws apply to both cigarettes and e-cigarettes, meaning employees cannot vape in their offices if smoking is prohibited.

Many office buildings in the UAE have strict no-smoking policies in place to comply with fire safety and air quality regulations. In June, the Ministry of Health and Prevention called on companies to implement tobacco-free policies and take disciplinary actions against employees who violate smoking prohibition procedures. This includes informing smokers of the policy, serving a written notice, integrating the policy into professional performance documents, and developing clear procedures for non-compliance. Visible signage should be displayed throughout the premises to strictly prohibit smoking without exception.

E-cigarettes and vaping devices may produce fewer odors than traditional tobacco products, but health authorities have warned against promoting electronic smoking products as safer alternatives to traditional cigarettes. According to the Ministry of Health, there is no scientific evidence to support these claims. While some employees continue to vape in their offices, it is important to be aware of and comply with the anti-smoking laws in the UAE. Designated smoking areas must adhere to strict conditions regarding isolation and ventilation set by the competent authority.

If employees choose to vape in their offices, they may be subject to fines or other penalties. It is crucial to respect the no-smoking policies in place and be considerate of colleagues who may have respiratory issues that could be aggravated by second-hand smoke. Ultimately, creating a tobacco-free workplace environment is not only important for compliance with laws and regulations but also for promoting the health and well-being of employees. Companies should take steps to enforce tobacco-free policies and educate employees on the risks associated with smoking and vaping.
