US actor Alec Baldwin is facing new challenges in his involuntary manslaughter trial, as a US prosecutor is seeking a reconsideration of the dismissal of the case. The prosecutor disputes the court’s ruling that key evidence was deliberately withheld by law enforcement authorities in the case against Baldwin. The prosecutor argues that the evidence was held back because it was deemed “immaterial” and there was no cover-up involved.

The incident that led to the charges against Baldwin occurred during a rehearsal on the movie set of Rust in October 2021, where Baldwin was pointing a gun that accidentally fired, killing cinematographer Halyna Hutchins and injuring the film’s director. Prosecutors accused Baldwin of acting recklessly and ignoring basic gun safety laws, while the defence argued that Baldwin had no responsibility for checking the weapon’s contents and was unaware that it contained live rounds.

The high-profile case went to trial in July but fell apart when Judge Mary Marlowe Sommer found that important evidence had been withheld from the defence. Live bullets potentially matching the round used in the fatal shooting were handed to law enforcement, but not disclosed to Baldwin’s lawyers. The judge ruled that the withholding of evidence was intentional and deliberate, leading to the case being dismissed against Baldwin, who could have faced up to 18 months in prison if found guilty.

Despite legal experts believing that Baldwin is unlikely to face another criminal trial over the shooting, prosecutors are now arguing that the buried rounds of ammunition were immaterial to the case against Baldwin as they could have been purchased at any gun store after the incident. They maintain that it was still Baldwin’s responsibility to handle the prop gun safely, regardless of how the live rounds were introduced to the set. The motion also requests Baldwin’s lawyers to explain how they learned of the ammunition handed to police, with the aim of creating a record for possible review by a higher court.

The legal battle surrounding the involuntary manslaughter trial of Alec Baldwin continues as prosecutors push for a reconsideration of the dismissal of the case. The dispute centers around the alleged deliberate withholding of key evidence by law enforcement authorities and the implications of this on the case against Baldwin. While the defense maintains his innocence, arguing that Baldwin had no knowledge of the live rounds in the prop gun, prosecutors believe that Baldwin’s responsibility for handling the weapon safely should not be diminished.
