Step-by-step guide on how to establish a business in UAE mainland

Setting up a business in the UAE has become increasingly popular, with entrepreneurs from all over the world flocking to the city to establish their businesses. To start a business in the UAE mainland, one must be at least 18 years old, according to the Commercial Transactions Law in 2023. The Ministry of Economy has outlined a few steps to follow when starting a business in the UAE. These steps include obtaining the necessary approvals, gathering the required documents, and taking the necessary steps to kickstart your business.

One way to apply for a business license in the UAE is through the unified Basher platform or the website of the concerned emirate’s economic department. Alternatively, one can apply in person through government service centers, Tasheel offices, legal services offices, or customer happiness centers. Additionally, there are different types of economic licenses available in the UAE, such as occupational, tourism, industrial, commercial, agricultural, and professional licenses. It is essential to identify the type of license that best fits your business activities.

Choosing the right legal structure for your business in the UAE is crucial, as it will determine the laws and regulations that your business must adhere to. There are several legal forms of businesses in the country, including sole establishments, civil companies, limited liability companies, public joint-stock companies, private joint-stock companies, branches of GCC companies, branches of local companies, holding companies, and representative offices of foreign companies.

Registering a unique trade name for your business is also a vital step in the process of setting up a business in the UAE. The trade name must comply with certain conditions, such as containing an abbreviation of the company’s legal structure as a suffix, being compatible with the nature of your business, and not bearing any resemblance to existing company names. Additionally, you must obtain approvals from the Department of Economic Development and the Ministry of Economy for your trade name.

After receiving initial approval from the UAE Government and creating a Memorandum of Association or Local Service Agent Agreement, you must choose a suitable location for your business. A physical address is necessary for each business, and the location must adhere to the regulations set by the Department of Economic Development and local authorities in the emirate. Finally, submitting the required documents, paying the necessary fees, and collecting your business license from service centers or online is essential to begin operating your business.

Ultimately, registering with the Chamber of Commerce and Industry in the corresponding emirate is the final step in setting up a business in the UAE mainland. The process of setting up a business in a UAE free zone follows a different procedure and requires distinct steps. By following these guidelines and fulfilling the necessary requirements, entrepreneurs can successfully establish and operate their businesses in the thriving business hub of the UAE.
