Woman wins court battle for refund in a four-year COVID event dispute

An event management company in Bahrain was ordered by a Civil Court to reimburse a Bahraini woman BD460 following a dispute that arose from a cancelled reception due to the COVID-19 pandemic. The woman had engaged the company to organize a reception for her mother in 2020, but it was called off due to the pandemic. Despite a previous court order, the company had only refunded BD160, leaving the woman with a balance of BD300.

The woman’s lawyer stated that the event, which included a reception and buffet costing BD460, was cancelled due to pandemic-related circumstances. The company, however, only returned BD160 despite repeated requests from the woman. The defendant argued that they had fulfilled their obligations and pointed to a ruling from the Consumer Protection Department that favored them. They claimed that they had already refunded BD160 and promised to credit the remaining BD300 for a future event.

During the court proceedings, the defendant acknowledged handwritten notes made by their employee that raised questions about invoicing discrepancies. The court recognized that both parties’ actions had implicitly terminated the agreement, as evidenced by the cancelled event and partial refund. As a result, the court ruled in favor of the claimant, granting her entitlement to the remaining balance of the payment, which was BD300.
