The Pain of Home: Mother’s Testimony Saves Son, but She Must Fight to Reclaim Her Home

In a recent case in Bahrain, a 60-year-old mother initially saved her son from a life sentence after testifying on his behalf, describing him as pious. However, she has now accused him of coercing her into transferring ownership of her home to him. The son had been sentenced to life in prison for the murder of his brother, but his sentence was later reduced to 15 years. The mother has filed a lawsuit against her son, claiming that he pressured her into gifting him the property before the murder incident.

The High Appeals Court heard both sides of the case and ultimately ruled in favor of the son, confirming the validity of the mother’s gift. The son’s lawyer, Abdulazeem Abbas Hubail, explained that the court considered testimonies from both the mother and son, as well as another brother who claimed that the defendant had coerced their mother into the gift. The court found the gift to be legally binding, despite the mother’s claims of coercion.

The son described his brother as a drug addict with a history of aggressive behavior, stating that he had feared his threats. He recounted an incident in early 2021 where his brother threatened to burn down the house if their mother didn’t transfer ownership to him. Witnesses corroborated the son’s account, highlighting the mother’s reluctance to part with the property and the son’s aggressive behavior. However, a long-term resident of the property testified that he had not observed any abusive behavior from the son towards his mother.

Additional witnesses, including a tenant in the property and the son’s wife, testified to the son’s attentive care for his mother. They emphasized his frequent visits, assistance with medical appointments, and overall dedication to her well-being. The court acknowledged the contradictory testimonies but ultimately ruled in favor of the son, citing the existence of a legally binding gift document signed by the mother and the lack of evidence of coercion.

The court emphasized that the gift was valid due to the mother’s status as a blood relative and her failure to challenge the document’s validity. Despite the mother’s claims of coercion and the testimonies presented to support her case, the court found the son’s evidence to be more compelling. The son denied the accusation of coercion and presented evidence to support his claim, ultimately leading to the court’s decision in his favor.

In conclusion, the court’s ruling confirmed the validity of the gift and upheld the mother’s transfer of ownership to her son. While the case involved complex familial dynamics and conflicting testimonies, the court ultimately found in favor of the son based on the available evidence. The legal proceedings highlighted the importance of thorough examination of testimonies and evidence in cases involving familial disputes over property ownership.
