A mother recently won a significant legal victory in Bahrain after the Third High Court of Appeals increased her compensation from BD1,300 to BD2,000 following a tragic traffic accident that left her daughter permanently disabled. The court also ruled that both the insurance company and the driver must cover legal fees and translation costs, acknowledging the family’s right to compensation for the emotional turmoil caused by the incident. Lawyer Zahra Naama, representing the victim’s family, shed light on the challenging circumstances surrounding the case.

The young woman involved in the accident sustained severe injuries to her left ankle and fractures in two bones of her heel, resulting in a permanent disability of 10% that required surgery. The driver was found guilty, prompting the family to pursue legal action for both financial and moral redress. Initially, the first-instance court ordered the insurance company and the driver to pay a total of BD5,300 to the plaintiffs, but denied any compensation to the victim’s mother. Dissatisfied with this decision, the plaintiffs decided to appeal the ruling.

Naama emphasized the need for a review of the judgment, urging the court to mandate that the defendants cover the victim’s medical expenses arising from the accident and to increase the compensation for each plaintiff to BD500, up from the BD300 previously awarded by the first-instance court. This case exemplifies the legal challenges families encounter when seeking justice, highlighting the emotional and financial stress they must navigate after life-altering events.

The outcome of this case illustrates the importance of seeking legal recourse after a tragic incident, as it can result in increased compensation and acknowledgment of emotional distress.
