Court auctions estate worth BD1.5 million as heirs engage in conflict

A family dispute over inheritance has been settled by a civil court in Bahrain, with the ruling ordering the sale of properties and vehicles valued at BD1.5 million. The conflict arose when the other heirs refused to pay their share of the inheritance, leading the plaintiff to take legal action. The estate includes three cars and five properties, which were managed by one of the heirs who controlled the distribution of shares. Lawyer Ali AbdulMohsen, representing the plaintiff, cited Article 790 of the Civil Code, which outlines the method for dividing shared assets.

The Court of Cassation clarified that a partner with an undivided share has the right to request the division of shared property. In this case, the properties in question were bequeathed by the plaintiff’s late father, giving her a legitimate claim supported by documentation. The court found that the properties could not be individually apportioned and ordered them to be sold at a public auction in accordance with the Code of Procedures. The proceeds will be distributed among the parties based on their respective shares as per legal obligations.

The plaintiff’s request to compel the defendants to return real estate revenues amounting to BD9,921 has been transferred to the Grand Civil Court for resolution. This case underscores the contentious nature of shared ownership and the potential for conflicts to arise when emotions run high. It also highlights the importance of following legal procedures outlined in the Civil Code to resolve disputes over inheritances and shared assets.

The ruling by the civil court in Bahrain serves as a reminder of the importance of clarity and transparency in estate planning to avoid potential disputes among heirs. Clear documentation and legal processes must be followed to ensure that each heir receives their rightful share of an inheritance.
