Designer of Abayas receives BD250 as prize

A Bahraini court recently ruled in favor of a 60-year-old abaya designer, awarding her BD250 in compensation from a 20-year-old designer who had allegedly copied and sold her designs. The court cited moral damages inflicted on the senior designer by the actions of the younger designer. The senior designer, who sells her abayas through social media, accused the younger designer of stealing her designs and selling them at lower prices. The younger designer had reportedly copied images of abayas from the senior designer’s social media account and passed them off as her own.

Lawyer Zahra Naama, representing the senior designer, stated that her client had suffered significant financial losses as a result of the theft of her designs, which were her sole source of income. Naama also emphasized the emotional distress experienced by the senior designer due to the infringement. Following a criminal complaint, the public prosecution issued a fine of BD20 against the younger designer for misuse of communication devices.

In response to the criminal complaint, the senior designer filed a civil lawsuit seeking further compensation for the moral damages she had endured. The Civil Court of First Instance ruled in favor of the senior designer, acknowledging the emotional impact of the infringement on her. The court highlighted the connection between the younger designer’s actions and the emotional harm experienced by the senior designer, especially considering the theft of her intellectual property.

This case serves as a reminder of the importance of protecting intellectual property rights and respecting the work of designers. The court’s decision to award compensation to the senior designer sends a strong message about the consequences of intellectual property theft and the emotional distress it can cause.
