As a property owner in Dubai, it is crucial to understand your rights and obligations regarding leased premises. According to Article 24 of Law No. 26 of 2007 in Dubai, a tenant is not permitted to sublet a rented property without the written consent of the landlord, unless it is specifically agreed upon in the lease agreement. If you suspect that your tenant has sublet a room in your apartment without your knowledge, you have legal recourse to address this issue.

Under Article 25 (1) (b) of Law No. 33 of 2008, a landlord has the right to request eviction of the tenant if they sublet the property without obtaining written approval. This eviction notice would apply to both the tenant and the subtenant, who may also have the right to claim compensation from the tenant. Therefore, if you have discovered that the family renting your 2-bedroom flat has sublet a room without your consent, you may have grounds to take action against them.

As the apartment owner, you can follow a few steps to address this situation effectively. Firstly, review the rental agreement to understand any clauses related to subletting and consent requirements. Next, communicate with the tenant both verbally and in writing to inform them of the violation and request action. You may consider issuing a formal written notice through a Notary Public or registered post to demand eviction and compensation.

If the tenant does not comply with the eviction notice, you have the option to seek legal recourse through the Dubai Rental Dispute Centre (RDC). The RDC has jurisdiction over disputes between owners and tenants in Dubai, providing a legal avenue to resolve the issue. It is crucial to follow the legal procedures and seek professional advice to ensure that your rights as a landlord are protected in this situation.

In conclusion, as a property owner in Dubai, it is essential to be aware of your rights under the tenancy laws and take necessary steps to address any violations by tenants.
