The Primary Court in the Wilayat of Barka has issued a significant ruling against a commercial establishment and its owner, demonstrating the country’s commitment to safeguarding consumer rights. This case serves as a crucial reminder for businesses to prioritize fulfilling their contractual obligations and maintaining transparency in their dealings with customers.

Barka Court Issues Fine for Breach of Consumer Protection Law

The court’s decision stemmed from a complaint filed with the Consumer Protection Administration in Barka. A consumer alleged that a local commercial establishment had failed to deliver on a contract to manufacture custom home furniture. The agreed-upon items – sofas, beds, and curtains – were valued at OMR 1,500, with an initial advance payment of OMR 700 made by the consumer. The agreed-upon completion timeframe was three months.

Details of the Consumer Complaint

Unfortunately, the establishment did not deliver any of the promised furniture within the stipulated timeframe. This prompted the consumer to seek redress through the Consumer Protection Administration, requesting a full refund of the OMR 700 advance payment. The Authority investigated the matter, and when confronted, the establishment’s owner admitted to the contract and the subsequent delay. This admission led to the Authority initiating legal proceedings.

Legal Proceedings and Court Ruling

The case was subsequently referred to the Public Prosecution, which conducted a thorough investigation before presenting it to the competent court. After carefully reviewing the evidence and hearing arguments from both sides, the court found the establishment and its owner guilty of a misdemeanor – specifically, “failing to provide the service properly and in accordance with its nature.”

The court imposed a fine of OMR 1,000 on both the commercial establishment and its owner. Additionally, they were ordered to reimburse the consumer the original advance payment of OMR 700, and provide compensation of OMR 100 for the damages incurred due to the breach of contract. The contract itself was officially terminated. Furthermore, both parties are responsible for covering the costs associated with the criminal lawsuit. The civil claim aspect of the case has been referred to a separate court for further review.

The Consumer Protection Law, Royal Decree No. (66/2014) and its Executive Regulations, provides a clear legal basis for addressing grievances and holding businesses accountable.
