Woman avoids jail for Tubli car theft, sent to psychiatric facility

A woman who stole a car outside a supermarket in Tubli has been spared jail after the Appeals Court found her mentally unfit during the incident. The car’s owner had left his vehicle running while quickly entering the supermarket, only to have the woman jump into the driver’s seat and drive off. Despite his attempts to stop her, the woman made off with the car, leaving the owner with minor injuries. The stolen vehicle was later found in Hamad Town, and the woman was initially charged with car theft. The lower court sentenced her to one year in jail, but her lawyer successfully appealed the verdict.

In a turn of events, the woman’s lawyer, Huda Al Aswad, presented evidence of her client’s mental instability at the time of the crime. This led to the court ordering a psychiatric evaluation, which confirmed the woman’s condition. As a result, the Appeals Court decided to cancel her jail term and instead ordered her placement in a therapeutic facility at a psychiatric hospital until a judge deems her fit to be released. The theft took place in May 2024, and the car belonged to a financing company.

The Appeals Court referenced legal precedents that allow a defendant to be exempt from criminal responsibility based on their mental state. Citing Articles 31 and 87 of the Penal Code, the court ruled in favor of the woman’s acquittal. Lawyer Al Aswad argued for a psychiatric evaluation based on her client’s medical history and inability to be held responsible for her actions. This ultimately led to the decision to spare the woman from jail time and prioritize her mental health treatment instead.

This case highlights the importance of considering mental health issues when evaluating criminal behavior. In this instance, the woman’s mental instability played a significant role in the court’s decision to spare her from jail.
