The Saudi Data and Artificial Intelligence Authority (SDAIA) recently announced amendments to the regulation for transferring personal data outside the Kingdom. These updates aim to clarify the provisions and procedures related to transferring personal data in a way that ensures the protection and privacy of the data owners. As the competent authority overseeing the implementation of the law, SDAIA is focused on safeguarding personal data in other countries. The regulations cover various aspects such as assessing the level of protection of personal data, purposes of transferring data, exemption cases for controlling entities, subsequent transfer of data, waiver of exemption, and risk assessment when transferring data.

One of the key components of the updated regulations is the establishment of standards for assessing the level of protection of personal data outside the Kingdom. This is crucial in ensuring that data transferred outside the country is adequately protected and the privacy of data owners is maintained. The regulations also outline other purposes for transferring personal data or disclosing it to parties outside the Kingdom, providing a clear framework for data transfers. Additionally, the regulations address cases where controlling entities may be exempt from compliance with the requirements for transferring personal data, as well as the minimum level of protection required.

Furthermore, the regulations cover the subsequent transfer of personal data, specifying the procedures that need to be followed when transferring data from one party to another. They also address the waiver of exemption, outlining the circumstances under which exemptions may be waived. In addition, the regulations highlight the importance of assessing the risks associated with transferring personal data or disclosing it to a party outside the Kingdom. By conducting risk assessments, organizations can identify potential vulnerabilities and take appropriate measures to mitigate them.

Individuals and organizations can access the updated regulations on the SDAIA website, providing a comprehensive overview of the procedures and requirements for transferring personal data outside the Kingdom. By following these regulations, companies can ensure compliance with data protection laws and safeguard the privacy of data owners. The regulations serve as a valuable resource for organizations looking to navigate the complexities of data transfers while ensuring the security and confidentiality of personal data. With the growing importance of data protection and privacy, these regulations play a vital role in promoting a secure environment for transferring personal data internationally.
