UAE: Insurance companies deny claims from drivers who passed through flooded areas – News

The UAE experienced the heaviest rains in 75 years on April 16, leading to widespread flooding in Dubai, Sharjah, Ajman, and other emirates. Over 50,000 vehicles were damaged during the unprecedented rains. However, insurance claims for some motorists who drove through flooded streets have been rejected due to negligence. Only vehicles with comprehensive insurance policies are typically covered against losses from natural disasters under the natural catastrophe clause, while third-party liability plans do not usually cover such events. Insurers are rejecting total loss claims where it is found that motorists deliberately drove through flooded streets.

According to Avinash Babur, CEO of Insurancemarket.ae, insurance policies exclude coverage for damages resulting from negligent behavior, such as driving through deep water during a storm. Even if a vehicle sustains severe damage or is declared a total loss, claims are likely to be denied if intentional or reckless driving is determined. Moin ur Rehman, executive director of Unitrust Insurance Broker, mentioned that policies’ terms and conditions may be disregarded in cases of willful actions, resulting in denied coverage for damages caused by such behavior. Toshita Chauhan, business head for health and motor insurance at Policybazaar.ae, also confirmed instances where claims were rejected due to motorists intentionally driving on flooded roads.

Insurers are carefully reviewing claims related to the April 16 rains to determine the circumstances under which vehicles were damaged. The focus is on ensuring the validity of claims by verifying that the vehicles were not driven through flooded areas during or immediately after the rainfall. Once a claim passes this scrutiny, repair approvals are swiftly granted, and vehicles are sent to workshops for necessary repairs. However, claims are rejected if it is established that the vehicle was driven through water or adverse weather conditions. It is crucial for motorists to adhere to safety guidelines and road regulations to avoid claim rejections due to negligence.
